GENERAL TERMS AND CONDITIONS OF THE CORAL CROATIA d.o.o. GIFT CARD

The issuer and owner of the Coral GIFT card (hereinafter: the Card) is Coral Croatia d.o.o., established in Zagreb, Budmanijeva 5, personal identification number (PID): 72594208197 (hereinafter: Coral or the Issuer)

A buyer is any person (natural or legal) to whom Coral issues the Card after that person pays a certain amount of money to Coral, all in the way and under the conditions described in these General Terms and Conditions of the Coral Croatia d.o.o. Gift Card (hereinafter: the General Terms and Conditions). The Card’s User is, apart from the Buyer, any person who identifies themselves with the Card when using a service. These General Terms and Conditions govern the rights and obligations of Coral as the Card’s Issuer, as well as the rights of the Buyer and the User.

ISSUING AND USING THE CARD

1.1. The card is issued in plastic form with a unique machine-readable record and a unique identification number readable by the Buyer and User. The Card is not bound to a certain name and is therefore transferrable. When making a purchase, the Buyer can specify the amount that will be deposited onto the Card, with the minimum allowed amount on the Card being EUR 15.00 / HRK 113.01, and the maximum allowed amount on the Card being EUR 2,654.45 / HRK 20,000.00. Once the Card is purchased, it will be activated the following day after 2 p.m. The Card cannot be purchased by making a deferred payment or in instalments.

1.2. The Card is a means of payment that can be used to pay for all available goods and services exclusively at Coral points of sale in the Republic of Croatia, at the retail prices valid at the time of purchase at a particular point of sale, up to the amount for which the card was issued, i.e. up to the amount available on the card. The amount available on the Card can be used more than once. One receipt can be paid with multiple Cards. The Card can be used to pay for the total balance due or only one part of it.
When making a purchase with the Card, if the balance due is lower than the amount available on the Card, the User can use the Card in successive purchases until the funds on the Card have been completely depleted. The Card can only be used during its period of validity. If the amount on the Card is insufficient to settle the entire balance due, the User must pay the remaining amount with other payment methods accepted at the Coral point of sale at the time of purchase.

1.3. A receipt that was paid using the Card cannot be paid in any form of instalments.
The Card cannot be used to buy products in instalments. The Card cannot be exchanged for money. The funds on the Card cannot be withdrawn as cash in any amount. The User cannot use multiple Coral Cards when making a purchase.

1.4. The Gift Card is connected to the Issuer’s online system. If the online system is not working, i.e. if technical issues on the part of the Issuer have made it impossible to check the available balance on the Card, the Issuer shall be under no obligation to proceed with the payment by accepting any amount that the Card is advertised to contain until connection has been restored with the Issuer’s database.

1.5. By completing a purchase, the User shall receive a retail fiscal receipt displaying the amount of the transaction.

1.6. Since the Card is transferrable without restrictions, the Issuer shall not be held liable for any misuse of the Card and is not required or able to verify the identity of the User. The Issuer shall not be held liable for any loss of the Card, nor can a request be made requesting the cancellation of a lost/stolen card. By receiving the Card, the Buyer and/or User accept the risk of the Card being misused, damaged, and/or lost. The Buyer and the User are fully responsible for the use and safekeeping of the Card. The Buyer shall ensure the correct usage of the Card and the prevention of misuse. Coral shall not be held liable for any cases in which a person uses the Card without permission and/or approval of the Buyer, and in such cases the Buyer shall bear sole responsibility.

1.7. Coral shall not be held liable for the loss, destruction, or misuse of the Card by third parties. It is forbidden to write, erase, cross out, or rectify anything on the Card. Otherwise, the Card will be deemed invalid, and Coral will not accept it as a means of payment. In the above mentioned cases, the Buyer and the User shall not be eligible for a refund or compensation for any damages.

1.8. The Card is valid for 24 (twenty-four) months after being issued. If the amount on the Card is not used to buy goods or services in that period, the Card will be cancelled. The Buyer can check the Card’s period of validity on the receipt received when purchasing the gift card. After the period of validity has passed, the Card shall be deactivated and it shall no longer be possible to spend any unspent amount left on the card.

FINAL PROVISIONS

2.1. By using this Card, all Buyers and Users accept these General Terms and Conditions.

2.2. All conditions of issuing the Card are independently determined and evaluated by Coral. Coral is authorized to deny a request for issuance of the Card with no explanation and/or responsibility towards the persons who made the request, in accordance with the company’s judgment.

2.3. In case a certain provision of these General Terms and Conditions becomes invalid, all of the other provisions shall remain valid and unchanged. Coral undertakes to replace the invalid provisions with those that are legally valid.

2.4. Coral reserves the right to amend these General Terms and Conditions. The Buyer and the User will be notified of any such actions via the company’s website www.coralenergy.hr. The Buyer and the User of the Card shall be deemed to be familiar with the amendments or changes to the General Terms and Conditions once the amendment and/or change is published on www.coralenergy.hr.

2.5. The point of sale for the purchase of any goods and services the Buyer pays for with the Card shall be any Coral gas station in the Republic of Croatia.

2.6. For any disputes that may arise in connection with the use of the Card, the competent court in Zagreb shall have jurisdiction.

2.7. These General Terms and Conditions shall enter into force on 15 March 2022. These General Terms and Conditions shall remain valid until new General Terms and Conditions of the Coral Gift Card are drawn up.
